Getting a complaint open with the CSLB took a very large crow bar. They have been operating outside of state statutes and guidelines for at least 20 yeasrs, if not 30 or more. This agency had seemingly been hijacked for decades.

On 6/29/2023 I filed a complaint against 2 contractors.
All CA laws and regulations suggest any person can file complaints and verified complaints shall be taken up for investigation.
I had 4 different voice interactions with two CSLB's employees who stated adamantly that they only are chartered to open investigations for people who had contracted directly with a contractor. There was/is no mechanism for third parties to file complaints.
I finally received that in writing on 9/9/2023 and the 4th voice interaction transpired on 9/11/2023 confirming that document.
Then, on the eve of 9/11/2023, I posted this webpage, which shows the very first paragraph of the first section of the Disciplinary Proceedings for Contractors states their position is false, and that same section goes on to state my complaint about no permit for a deck deconstruction and reconstruction alone requires discipline.
CA is the 4th Largest Economy in the World
When this is combined with the other Administrative oversight failures related to the
California Association of Realtors (CAR),
the Real Estate Brokerage System, CA Attorneys and the CA Bar,
the Structural Pest Control Board, the Loan Originators, the Work Comp Industry, and more...
it's safe to say now that CA is a fully failed Administrative State.
There is no shortage of laws on the Books. There's just no one home to enforce them.
As much as it would be nice to have larger conversation about COVID problems in CA,
there's nobody home.
If this is Kamala or Gavin Newsom's idea of "managing the business of this state",
I'd suggest we all pass.
The very first paragraph of the the very first section for disciplinary proceedings states investigations shall be pursued for any verified complaints from "any person".
Furthermore, that same section specifies disciplinary action "shall" transpire for failing to pull building permits.
No permits were pulled for $50,000 in work by the GC or the Painter. Ooops.
Of most and immediate interest, however, is that one of the 7 specific complaints I made against the GC is for failing to pull a permit for the deconstruction and reconstruction of a 2nd story deck.
Timeline
2023/06/29 - Mailed in complaint to CSLB via USPS view

2023/07/26 - Returned complaint acknowledge form indicating no agreements had been reached. view
2023/08/15 (est) - Phone conversation with "C" from CSLB. She indicated they only opened investigations for people who were engaged to a contractor via contract. No third party can file complaints that lead to investigations. A Fully illogical conversation transpired for almost 30 minutes. I tried every angle I could. I bothered her enough that she chose to hang up on me. In that process she revealed her boss "M", was not available , but her bosses boss, "A" was and she would speak with her to confirm the position she had shared and call me back. To my surprise, after the hang up, she did called back and confirmed that "A" supported her position. I asked her to ask her boss, "M" to call me, and she said she would.
2023/08/17 (est) - Approximately 48 hours later "M" left me a voicemail with her call back number. She reiterated the fact that they only open investigations for parties that had directly engaged in a contract with a contractor.
2023/08/22 - Sent email with attachment to "C"' to forward to M". I requested a position statement in writing. Email receipt was confirmed but I never heard back. view view2
2023/09/09 - Received two notices in mail. "we are closing the file because you did not have a contractual agreement with ________. " view view
2023/09/11 - "M" called me. She reiterated the position that the CSLB does not get involved in investigations if the person who contracted is not filing the complaint. Our call was cut short because I was at the dump. We played phone tag later in the day.
